The landlord can then claim this amount as a tax credit while filing their income tax return with the Income Tax Department of India.<\/p>\n\n\n\n<p><em><strong>Note<\/strong>: Under Section 194-IB, the amount of TDS deducted cannot exceed the rent of the last month of the tenancy. This provision ensures that tenants do not have to pay the tax from their own pocket if the calculated TDS amount becomes higher than the final month\u2019s rent.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-when-should-the-tenant-deduct-tds\" style=\"font-size:22px\"><strong>When Should the Tenant Deduct TDS?<\/strong><\/h2>\n\n\n\n<p>Section 194-IB says that the tenants need not be required to deduct TDS every month. Instead, it says that the tax deduction should be made once at the end of the tenancy period or at the end of the financial year, whichever happens earlier.<\/p>\n\n\n\n<p>When in practice, this means the tenant can deduct the total TDS amount while making the last rent payment of the year or when vacating the property. Once the tax is deducted, it must be deposited with the government within 30 days from the end of the month in which the deduction is made.
