Synopsis: Gambling in India remains illegal, primarily under the Public Gambling Act, 1867, that prohibits betting and gambling activities. However, there are certain states in India that have the authority to regulate gambling within their jurisdictions.

Gambling laws in India are very complicated, legality changes from state to state. Casinos  are legal only in selected regions as gambling is banned in most parts of India under the Public Gambling Act of 1867. Gambling laws differ across India because under its Seventh Schedule, the Constitution grants each state & UT of the country the exclusive power to enact its own laws on “betting and gambling” for its own territory and due to that some states and UTs allow these activities.

Goa

Goa is India’s casino spot. It has both sea and land-based casinos that are allowed to operate under the Goa, Daman and Diu Public Gambling Act, 1976. The sea casinos are on boats that anchor on the Mandovi River near Panaji. Land casinos are only in five-star hotels. The casino business is a huge part of Goa’s tourist economy. The state made over ₹1,749 crore from casinos in the five years. There are 6 sea casinos and 17 land casino licences in Goa. Some main casino areas in Goa are Panaji, Candolim & Mandovi River belt. The casino boats on the Mandovi River are a tourist draw in Goa. They still have issues with the environment and rules but they bring in a lot of money and people like visiting them.

Sikkim

Sikkim is another state in India where you can find casinos as they are allowed to operate under the Sikkim Casinos Control and Tax Act, 2002. These casinos are usually found in luxury hotels , the main reason is to get tourists to visit Sikkim so that the state makes more money. Sikkim is special because it was one of the few places in India to make rules for online gaming with the Sikkim Online Gaming Regulation Act, 2008. The gaming is controlled and safe; mostly these activities can only happen within Sikkim.

Daman & Diu

Daman is also another place where people can go to casinos in India. The rules say that casinos are allowed in hotels and resorts in Daman. These rules are similar to the ones in Goa as they come under the same Law. People in Daman want it to be a place where tourists come to have fun. They think that having casinos will make tourists spend more money and invest in hotels. The casino business in Daman is not as big as it is in Goa but slowly it is getting bigger.

Online Gambling & Betting in India

Nagaland is one of the few states in India that has rules for online skill games. This is because of the Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act that was made in 2015. The law says that companies that have a license can offer games where skill is more important than luck. These games include: Poker, Rummy, Fantasy sports & Virtual sports strategy games. The state of Nagaland makes a difference between games that need skill and gambling. It allows companies that have a license to run these kinds of platforms legally.

Online gambling laws in India are still not clear because there is no single law for the whole country that fully regulates online betting platforms. The government has become stricter on betting and real-money gaming platforms in recent years as in 2025 Parliament passed the Promotion and Regulation of Online Gaming Act. After that many betting and gambling websites were blocked across India.

The Ministry of Electronics and Information Technology (MeitY) says that by March 2026 over 8,376 URLs related to gambling had been blocked. The rules for taxes have also become stricter, in India, online gaming, casinos and horse racing activities have a 28% GST.

Risks & Concerns Around Gambling

Despite bringing in tourism, money and taxes gambling and casino activities are still a worry in India. One big problem is that people are getting addicted to gambling, especially the younger generation who use online betting sites and gaming apps.

There are also concerns about betting groups, money laundering and financial cheating as there are many unregulated offshore gambling websites operating in India. Online gaming and betting sites are growing rapidly which makes regulators pay attention to monitoring taxing and protecting consumers.

Future of Gambling Laws in India

India’s laws about gambling and online games are going to get stricter. The government made a law called the Promotion and Regulation of Online Gaming Act in 2025 (PROGA)and the new Online Gaming Rules officially came into force from May 1, 2026. These rules mean that people have to prove how old they are to play games where they can win money. All the companies that make these games have to register with the government. They also have to have a system to deal with complaints from players. The government is watching closely how people spend their money on these games.

The government is also stopping people from using apps and websites that are not safe but some companies that make those games are not happy with these rules and they are taking the government to court. Experts think that in the future the government will make rules to help keep people safe when they play games. The government wants to make sure that esports are not the same as gambling and lastly Indian laws about games and gambling will keep on changing.
